Litigating an Energy, Natural Resources, or Environmental Case 2022: Avoiding Conflicts

Natural resources litigation generates unique conflict issues. This presentation explores positional conflicts as they arise and how to identify them before selection of counsel. It also examines whether all conflicts can be waived, how far “screening out” a conflicted lawyer can ethically extend, and whether some conflicts simply cannot be waived, particularly when litigation is involved. The pros and cons of advance conflict waivers are evaluated, including a discussion of whether such waivers are ever enforceable. Lastly, our speaker examines current methods used by companies and outside counsel to process conflicts, including their timeliness and success in effectively identifying conflicts.
