Public Land Law, Regulation, and Management 2022: Common Versus Uncommon Mineral Determinations and Implications for Developing Locatable or Saleable Mineral Deposits

Sand and rock deposits on federal lands are not typically relocatable under the Mining Law of 1872 and are usually developed under federal mineral sale contracts. But what happens when the sand or rock is unique enough to be considered a locatable mineral subject to a mining claim? This presentation examines two case studies involving pumice for stone washing garments and sand that can be used as a proppant in oil and gas hydraulic fracturing operations, the factors federal agencies take into account when considering whether a sand or stone deposit is common or uncommon, and how such factors affect validity examinations for mining claims.
