You regularly advise on development and operations in Texas but want a better understanding of the differences and similarities between Texas and New Mexico oil and gas law. This discussion will contrast Texas and New Mexico, focusing on the regulatory process for taking over existing operations, initiating new development projects, and asset retirement obligations, including work with the New Mexico Oil Conservation Division, Bureau of Land Management, and State Law Office v. the Texas Railroad Commission on transferring ownership, operatorship record title, bonding, permitting, etc.; revising contracts for New Mexico, including Transition Agreements and provisions that contemplate the NM Oilfield Anti-Indemnity Act; compulsory pooling in New Mexico v. production sharing agreements, allocation wells, and the Mineral Interest Pooling Actin Texas; and new developments in drilling and locating facilities across the state line.
